Data protection information on our handling of applicant data under Articles 12, 13, 14, and 21 of the General Data Protection Regulation (GDPR).

Thank you for your interest in our company. According to the provisions of Articles 12, 13, 14, and 21 of the General Data Protection Regulation (GDPR), we wish to inform you about our processing of personal data provided by you as part of the application process and any personal data collected by us as well as about your respective rights. Please read the following information carefully to ensure that you are fully informed about the processing of your personal data as part of the application process.

3. Purposes and legal bases of processing

We process your personal data under the provisions of the General Data Protection Regulation (GDPR) of the European Union and the German Federal Data Protection Act (BDSG) to the extent necessary in order to facilitate the decision concerning entry into an employment relationship with us. The legal basis is Article 88 GDPR in conjunction with Section 26 BDSG for employment purposes, if required as part of the decision to establish an employment relationship.

Moreover, we may process your personal data to the extent necessary to fulfill legal obligations (Article 6(1)(c) GDPR) or to defend against or assert legal claims based on Article 6(1)(f) GDPR. A legitimate interest is, for example, a burden of proof in proceedings under the German General Act on Equal Treatment (AGG). The legal basis for this is Article 6(1)(f) GDPR. If you grant your express consent to the processing of personal data for specific purposes, this processing is lawful under Article 6(1)(a) GDPR based on that consent. You can revoke your consent at any time with prospective effect (see section 9 of this data protection information).

Should an employment relationship be concluded between you and us, we may process your personal data already received for the employment relationship under Article 88 GDPR in conjunction with Section 26 BDSG to the extent necessary for the performance or termination of the employment relationship or to exercise or fulfill the rights and obligations of the employee representative body arising from a law or wage agreement, or a works or service agreement (collective agreement).

4. Categories of personal data

We only process data related to your application. This may involve your general personal data (like name, address, and contact details), information on your professional qualifications and educational background, details of further professional training, and any other data you provide during your application.

5. Data sources

We process personal data received from you by post, email, or which you have transmitted to us via professional social networks (e.g., LinkedIn) when contacting us or submitting your application.

6. Data recipients

Your personal data will only be passed on within our company to those departments and individuals who need it to fulfill contractual and legal obligations or to pursue our legitimate interests.

Your personal data may be processed on our behalf based on data processing agreements under Article 28 GDPR. In such cases, we ensure that the processing of personal data will be carried out in compliance according to the provisions of the General Data Protection Regulation.

Otherwise, data will only be passed on to recipients outside the company if this is permitted or required by law, if the transfer is necessary to fulfill legal obligations, or if we have your consent.

7. Data transfer to a third country

We will not transfer your data to a third country / non-EU country.

8. Duration of data storage

We store your personal data for as long as necessary to decide on your application. Your personal data or application documents will be deleted no later than six months after the end of the application process (e.g., the date of notification of a rejection decision) unless extended storage is legally required or permitted. Beyond this, we only store your personal data in the event that it is required by law or in specific cases for a legal dispute to assert, exercise, or defend legal claims.

If you have consented to your personal data being stored for a longer period, we will keep your data pursuant to your declaration of consent.

Should the application procedure result in an employment, training, or internship relationship, your personal data will continue to be stored and later transferred into your personnel file where necessary and permissible.

You may receive an invitation to join our talent pool as a result of the application process, allowing us to consider you for suitable vacancies in the future. Upon receiving your consent, we will store your application data in our talent pool following your consent.

9. Your rights

Every data subject has the right of access under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to notification under Article 19 GDPR and the right to data portability under Article 20 GDPR.

Also, you have the right to complain to a data protection supervisory authority under Article 77 GDPR if you believe your personal data is being processed unlawfully. The right of complaint exists without prejudice to any other administrative or judicial remedy.

If the data processing is carried out based on your consent, you are entitled to withdraw your consent to the use of your personal data at any time under Article 7 GDPR. Please note that your revocation will only take effect in the future; it does not affect any processing that took place before your revocation. Please also note that we may have to retain specific data for some time in order to follow legal requirements (see section 8 of this data protection information).

10. Right to object

To the extent that your personal data is processed under Article 6(1)(f) GDPR to protect legitimate interests, you have the right under Article 21 GDPR to object to this data being processed at any time for reasons arising from your particular situation. We will no longer process this personal data unless we prove overriding legitimate grounds for such processing. Such legitimate grounds must override your interests, rights, and freedoms, or such processing must establish, exercise, or defend legal claims.

11. Need for provision of personal data

You are providing your personal data voluntarily as part of the application process. A decision on whether to accept an employment relationship with you can only be made, and an employment relationship may only be established with you, if you provide enough personal data to complete the application.

12. Automated decision-making

We do not base our decision solely on the automated processing of your application. As such, no automated decision-making occurs on an individual basis as defined in Article 22 GDPR.
